PRIVACY POLICY

 

This privacy policy (the Policy) sets out in accordance with the Privacy Act 1988 (Cth) the way in which Sally-Ann Gordon (Sally-Ann, We, Us, or Our) may collect, store, use, manage and protect your Personal Information.

By:

  1. using this website;
  2. accessing, requesting, enquiring about, or receiving services (either online or in person); or
  3. providing Personal Information to Sally-Ann, her agents or employees

After this Policy has been brought to your attention, you acknowledge and consent to the use, collection, storage or disclosure of your Personal Information by Sally-Ann in accordance with this Policy and the Privacy Act.

If you do not agree to Sally-Ann handling your Personal Information in the manner set out in this Policy you must immediately cease to access this website or Sally-Ann’s products and services, and you should not provide Sally-Ann with any of your Personal Information.

1. What is Personal Information?

Sally-Ann follows the definition of Personal Information given in the Privacy Act:

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

 2. What is Sensitive Information

Sensitive Information is any Personal Information that is about your:

  1. health, treatments or other medical needs; or
  2. race, ethnicity or religion.

3. What kinds of Personal Information might Sally-Ann collect and hold?

Sally-Ann may collect (and hold) different Personal Information from you depending upon how you interact with Her.

If you access Sally-Ann’s website, She may collect information about how you have used Her site.

If you contact Sally-Ann, She may collect your name, address, e-mail address, phone number or contact details.

Sally-Ann may also collect information about:

  1. your individual needs;
  2. the needs and Sensitive Information of you and your children or children in your care;
  3. what services you are requesting or enquiring about;
  4. your health care history;
  5. you or your children’s, or children under your care’s treatment history and other health and allied health professionals;
  6. your location; and
  7. the name and address of any educational or medical service or centre that you or your child attends, and the name of the relevant contacts at that place.

By providing Sally-Ann with any Sensitive Information, You hereby consent to Her using that information in any of the way, and for any of the purposes, described in this Policy.

4. How does Sally-Ann collect Personal Information?

Sally-Ann collect Personal Information:

  1. directly from you (when She contacts you, when you contact her, [when you visit Sally-Ann’s rooms, when you post about Sally-Ann on social media, [when you complete a case history form, enquire about a service, receive a service, or otherwise give Sally-Ann Personal Information];
  2. from third parties who you have authorised to provide Sally-Ann with information; and
  3. publicly available information and databases.

5. How does Sally-Ann hold and secure your Personal Information?

Sally-Ann stores your Personal Information secure storage on site, and in digital format on password protected computers.

6. Why does Sally-Ann collect, hold, use and disclose Personal Information?

Sally-Ann may collect Personal Information for a number of reasons, including:

  1. providing you, your children or children in your care with services;
  2. co-ordinating the provision of services with third party providers and working ;
  3. managing and administering waiting lists;
  4. providing you with information about Sally-Ann’s services;
  5. developing or refining services;
  6. internal business purposes;
  7. providing you with marketing material;
  8. contacting you in relation to Sally-Ann’s business activities;
  9. managing payments through Disability Care Australia (the NDIS) and other government funding services or schemes;
  10. processing claims to health insurance providers; and
  11. corporate governance, auditing and record keeping.

 

Sally-Ann’s use of Personal Information may extend beyond these uses, but will be restricted to purposes that She consider to be related to Her functions and activities.

7. What does Sally-Ann do with your Personal Information?

If Sally-Ann collects Personal Information from you, She may:

  1. use that information for any of the purposes in clause 6 of this Policy;
  2. store that information in accordance with this Policy;
  3. pass that information to other health care providers and educators she works with;
  4. pass that information to third parties who provide products or services to Her (including accountants, auditors, lawyers, Government departments, schools, health and allied health professionals, and other service providers);
  5. provide your Personal Information, including Sensitive Information to health professionals, health care providers, educators, government agencies and medical experts where necessary to co-ordinate therapy and funding for you, your children or children under your care, or to assess your needs and the suitability of Sally-Ann’s services for you.
  6. provide that information to third parties as required by law.

8. Does Sally-Ann ever send your information overseas?

Sally-Ann will not provide your Personal Information to any overseas entities without telling you first.

9. Can you access your Personal Information or request it be corrected?

  1. You may request access to the Personal Information that Sally-Ann hold about you by contacting Sally-Ann by any of the methods as set out in paragraph 12, below (an Access Request).
  2. Upon receiving an Access Request Sally-Ann may request further details from you to verify your identity. Sally-Ann reserves the right not to provide you with access to Personal Information if She cannot verify your identity to Our reasonable satisfaction.
  3. An administrative fee may be charged to cover Sally-Ann’s costs in providing you with access to your Personal Information. This fee will be explained to you before it has been incurred.
  4. Sally-Ann will respond to your Access Request within a reasonable period of time by:
    1. providing you with access to your Personal Information;
    2. rejecting your Access Request, and providing you reasons for this rejection.
  5. Access Requests may be denied where:
    1. Sally-Ann believes your request is frivolous or vexatious;
    2. Sally-Ann is entitled to reject it by law;
    3. Sally-Ann is unable to verify your identity; or
    4. you have not paid the administrative fees referred to in paragraph 9c, above.
  6. If you believe that the Personal Information that Sally-Ann holds is inaccurate or otherwise requires correction, you may send Sally-Ann a correction request by contacting Sally-Ann by any of the methods as set out in paragraph 13, below. Sally-Ann will review your Personal Information and respond to the request within a reasonable period of time.

10. What happens if you want to deal with Sally-Ann anonymously or using a pseudonym?

You can deal with Sally-Ann either anonymously or by using a pseudonym if you choose. If, however, you do so She may not be able to provide you with accurate or useful information, and you may not be able to access a full range of her and services.

11. Does this policy ever change?

From time to time this policy may be changed. If this occurs, changes will be highlighted in bold. Changes come into effect from the time when they are brought to your attention, or when you next log on to Sally-Ann’s website, whichever is earlier. Please make sure you review the Privacy Policy each time you visit Sally-Ann’s website to keep up to date on any changes.

12. What happens if you have a question or complaint about how Sally-Ann has handled your Personal Information?
